Another important part of a real estate attorney’s practice is due diligence investigations. A real estate attorney’s due diligence investigation may include a review of the physical details of the property and can include an environmental investigation (to ensure there is no contamination), reviewing the leases of any tenants at the property, and reviewing the title to make sure the seller actually owns the property and there are no easements, mortgages, or other liens on the property, including tax liens.

In those cases where real estate disputes arise, real estate attorneys will be required to litigate their clients’ disputes in court. In litigation, real estate attorneys may be asked to handle matters concerning breach of contract, zoning compliance, construction defect, foreclosure, homeowners associations, or boundary disputes, among other issues.
